Temporary Residence
Spousal Open Work Permit
An open work permit for the spouse or partner of certain permit holders or applicants.
Overview
A spousal open work permit allows the spouse or common-law partner of an eligible principal applicant to work for almost any employer in Canada, rather than being tied to one job.
IRCC narrowed eligibility in 2024 and again in January 2025. Spouses of international students now generally qualify only if the student is in certain programs, such as longer master's programs, doctoral programs or select professional degrees. Spouses of foreign workers generally qualify only if the worker is in a management or professional occupation, or certain other skilled occupations linked to labour shortages, and has enough time left on their permit. Families of some permanent residence applicants, and of workers under certain trade agreements, follow different rules.
A spouse or partner being sponsored for permanent residence from inside Canada uses a separate open work permit option linked to the sponsorship application. Because these rules keep changing, we always confirm current criteria before advising on whether this pathway is open to you.
Who may consider this: Spouses or common-law partners of eligible work or study permit holders, or of certain permanent residence applicants.
Eligibility Considerations
- A genuine spousal or common-law relationship with the principal applicant
- For spouses of students: the student is enrolled in an eligible program, such as a qualifying master's, doctoral or professional degree program
- For spouses of workers: the worker is in an eligible management, professional or select skilled occupation, with enough time left on their permit
- Valid status for both partners while the open work permit is processed, where applicable
- No criminal or medical inadmissibility concerns
- Supporting evidence of the relationship (joint finances, shared residence, communication)
How It Works
Initial Assessment
We confirm whether the principal applicant's status currently qualifies a spouse for an open work permit.
Relationship Evidence Review
We identify what evidence best supports a genuine relationship for your situation.
Application Preparation
Forms are prepared for both the principal applicant (if needed) and the spouse.
Submission
The application is submitted together with, or linked to, the principal applicant's file as required.
Government Processing
IRCC processes the open work permit application; timelines vary by category and office.
Work Permit Issuance
Once approved, the permit allows the spouse to work for most employers in Canada.
Documents You May Need
Document requirements vary by applicant and pathway — not every applicant needs every item below. We confirm your specific list during an assessment.
- Proof of the relationship (marriage certificate or common-law evidence)
- Principal applicant's permit or application confirmation
- Valid passport and photos for both partners
- Evidence of a shared household or ongoing relationship
- Application forms specific to open work permits
Common Issues to Watch For
These are presented to help you prepare, not to cause concern — most are avoidable with careful preparation.
- Relying on older eligibility rules without checking the principal applicant's program or occupation against current criteria
- Weak relationship evidence, especially for common-law partners
- Submitting the spousal application before confirming the principal applicant's own status is in order
- Missing or outdated forms specific to open work permit categories
How We Help
- Check current IRCC eligibility rules against your specific situation before you apply
- Advise on what relationship evidence will meaningfully support the file
- Coordinate the timing between the principal applicant's status and the spousal application
- Prepare and review the full application package
Frequently Asked Questions
Is every spouse of a work or study permit holder eligible?+
No. Since the 2024–2025 changes, eligibility depends on factors such as the student's program or the worker's occupation and remaining permit validity. We confirm this against current rules before proceeding.
Can I apply at the same time as my spouse's own application?+
In many cases yes, but the approach depends on both applications' status and timing, which we assess together.
Is this an open work permit, meaning I can work anywhere?+
Yes, where approved, it generally allows work for most employers, unlike an employer-specific work permit.
What if my spouse's status changes while my application is pending?+
This can affect your application, so it's important to tell us right away if anything changes with the principal applicant's status.
My spouse is sponsoring me from inside Canada. Is this the right permit?+
No. Spouses and partners being sponsored for permanent residence from inside Canada have a separate open work permit option tied to the sponsorship application, and we can help you apply under that option instead.
